                Subject:       Review of the Memorandum of Agreement to form a Groundwater Sustainability
                               Agency for the San Timoteo Subbasin

               On Sept. 16, 2014, Governor Jerry Brown signed into law a three-bill legislative package, known
               as  the  Sustainable  Groundwater  Management  Act  of  2014  (the  “Act”).    The  Act  provides  a
               framework for sustainable management of groundwater supplies by local authorities, with a limited
               role for state intervention only if necessary to protect the resource.  The Act protects existing
               surface  water  and  groundwater  rights  and  requires  the  formation  of  local  groundwater
               sustainability agencies (GSAs) that must assess conditions in their local water basins and adopt
               locally-based management plans.

               The  District has  been  actively  involved  in  the  development  of the Groundwater  Sustainability
               Agency  for  the  San  Timoteo  Sub-Basin.    Additional  agencies  involved  within  the  basin  are
               Beaumont Cherry Valley Water District, the City of Redlands, San Gorgonio Pass Water Agency.
               Eastern Municipal Water District is represented as a stakeholder to the GSA and will be forming
               a separate GSA in their service area that covers the lower San Timoteo Basin.

               In order to become a Groundwater Sustainability Agency for the San Timoteo Sub-basin, each
               party of the Agreement must conduct a public hearing and obtain Board and/or Council approval.
               The attached Memorandum of Agreement has been scheduled for a public hearing at the June 6,
               2017 board meeting.  All documents required for the GSA must be submitted to the Department
               of Water Resources by June 30, 2017.
