Engineering

Mr. Blandon reported on the scope of work for the return flow.

B. Report from Hydrogeological Consultant – Thomas Harder, Thomas
Harder & Co.

Mr. Harder gave a brief report.

C. Report from Legal Counsel – Thierry Montoya, Alvarado Smith

Legal Counsel Thierry Montoya reported that at a hearing on Sept. 17
the court appointed Mark Swanson the alternate member for BCVWD.
The adjudication case has been assigned to a new judge.

A status conference is set on November 6 and the new judge has various
questions. The judge noted a clerical error on page 7, line 26 of the
judgment: the basin safe yield reads 8,610 AF. This must be amended
to reflect 8,650 AF. He recommended a resolution to amend the error,
and counsel will send a draft to the Board members for review.
